Privacy Policy

GENERAL PROVISIONS

1.1 This Privacy Policy (hereinafter – the “Policy”) by the current legislation of Monaco, including the Law “On the Protection of Personal Data,” applies to users of the Ciseles site and establishes the procedure for receiving, collecting, accumulating, storage, processing, use, protection, and disclosure of personal data (hereinafter – “Data”) of site users.

1.2 Data means any information relating directly or indirectly to the User. For example, Name, Surname, e-mail address, phone number, region of residence, IP address, data on the devices used by the User (computer, browser type, mobile device operating system), messages (information contained in correspondence between Users with each other, as well as in correspondence with the Site Administration), and other communication information that, at the User’s request, is provided to them using the registration form and/or when filling out their Profile on the site, writing a message and/or withdrawing, or information received when oral communication of users and site administration.

1.3 Processing of Personal Data means any action with Data, including access, provision, distribution, collection, systematization, storage, accumulation, recording, transfer, blocking, deletion, clarification, update and/or change, depersonalization, and other methods of use.

1.4 The Administrator of the Data is the Administration of Ciseles.

1.5 Users can provide Data independently by posting them on the Portal or by communicating through telephone channels and/or to the Company’s email and/or postal address, or Data can be provided from other sources, for example, user feedback (ratings, comments, confirmation of information) or other information from third parties provided in the course of sending claims, complaints and/or consideration of disputes and/or information from publicly available sources on the Internet.

1.6 The user has no right to use the Ciseles site if he does not agree with the terms of this Policy.

1.7 The User acknowledges that in the event of his neglecting the security and protection of his Data and authorization data (password, login), third parties may gain unauthorized access to the User’s account and Data. The site administration is not responsible for damages caused by such access.

WHAT PERSONAL DATA MAY BE COLLECTED

2.1 The Administration may collect the following data:

name, surname, patronymic, date of birth, gender, date of the authorized person of the company, name of the company, contact numbers, e-mail address, address of the location of the company, other communication data at the request of the User;

information about the User’s account, including phone number, e-mail address, login and password, other Data necessary to provide service to the users of the site, communication with Users, including when the User contacts the site’s support service;

information that Users provide when concluding contracts for the provision of services by accepting the agreement intended for the user posted on the site and/or concluding contracts for the provision of additional services on the site;

information necessary for communication between Site Users, including for the implementation and confirmation of agreements, receiving and sending messages, posting reviews, comments, and making payments;

data about the devices used by the User, information about user websites and/or their mobile Data (if the User uses a mobile application) such as IP address, date and time when the User uses the site, software information, as well as the Internet browser, information about the operating system of the mobile device, information about the operation of the User’s devices, individual identifiers of the devices used by the Users;

data obtained as a result of various surveys conducted by the site and/or third parties, related to improving the provision of services to Users; information received by the Site Administration as a result of marketing activities;

information posted by Users based on the results of their service, reviews, comments, appeals to the support service, complaints, claims, etc.

2.2 The Administration may also process Data using the following technologies:

Cookie files (cookies are small pieces of data that are sent to the user’s computer when visiting a web page and/or when viewing an advertising module on a web page and are stored on the user’s computer and/or in his mobile device);

pixels (pixels – digital images, an element of the matrix of displays that form an image), which allow tracking how often the User uses the web page to determine the User’s browser and provide services, for example, storing Data in the basket between visits; as well as to eliminate errors in the operation of the Portal, initiated by the User, while all information is processed “as is” and does not change during the Data collection process.

USE AND PURPOSES OF DATA PROCESSING

3.1 The site administration uses and processes Data for:

implementation of assigned functions, powers and duties by the current legislation of Monaco, as well as ensuring the implementation of civil-legal, economic, and tax relations;

for identification of the client as a User of the site, for communication with Users, including for the provision of services, payment processing, sending settlement transactions, providing reports, keeping accounting and management records, creating and implementing bonus programs, loyalty programs, sending mailings by mail, by e-mail, to a mobile phone number, including to send commercial offers, notification of promotions and news of Ciseles, improve the quality of service provision, forming ratings, analyzing user activity, performing keyword searches, managing traffic on the Portal, analysis and forecasting of user preferences and interests; conducting research and analytical activities, as well as ensuring compliance by Users of the Agreement, the Rules for posting information on the site, the Rules for the publication of reviews, the Rules for the design of product items, the Rules for posting ads.

3.2 The site administration does not process Data related to race, nationality, political views, religious and other beliefs, or membership in public associations. Information that characterizes the physiological features of users, on the basis of which it is possible to establish their identity, is not processed.

3.3 The terms of Data processing and storage are determined based on the purposes of Data processing, as well as based on the conditions specified in the contracts concluded with Users by the requirements of the current legislation of Monaco.

CONDITIONS FOR PROVIDING ACCESS TO DATA

4.1 Disclosure of Data is carried out when the User orders goods/services from Ciseles the seller/supplier of such goods and services, but only to the extent necessary for the identification of the User and his order.

4.2 In some cases, to demonstrate the effectiveness of the site and improve the image of the site, the Administration may disclose the statistics of the users’ sites without disclosing personal data and information that is a commercial secret.

4.3 The Portal will contain links to other web resources, to which this Policy does not apply when users go to them.

4.4 The Administration processes Data on a legal basis: Data is not disclosed to third parties and is not distributed without the User’s consent, except for cases provided for by the current legislation of Monaco and only in the interests of national security, economic well-being and human rights, in particular, but not exclusively:

upon justified requests of state bodies that have the right to submit applications and receive such data;

if, in the opinion of the Site Administration, the User violates the terms of this Policy and/or other contracts and agreements, as well as the provisions of the Agreement, the Rules for posting information on the Portal, the Rules for the publication of reviews, the Rules for the design of product items, the Rules for posting advertisements.

4.5 The site administration reserves the right, by the requirements of the current legislation of Monaco, to exchange data with state authorities to prevent fraud on the Portal, settle disputed situations and clarify circumstances that may be/become the cause of a violation of the current legislation, as well as in the event detection by the Company of illegal actions of Portal users and/or receipt of claims, complaints, appeals from third parties.

HOW TO CHANGE/DELETE DATA OR WITHDRAW CONSENT

5.1 Users can at any time change/delete personal information or refuse to receive newsletters, or withdraw their consent to Data processing through their account or by sending a message to the email address: administration@ciseles.com.

5.2 After receiving such notification, the processing of the User’s Data will be stopped, and the User’s Data will be deleted, except when such processing may be necessary by the current legislation of Monaco.

5.3 The functioning of some features of Ciseles, which require the availability of information about the User, may be terminated from the moment the Data is changed/deleted.

5.4 The Company processes and stores Data for the purposes specified in this Policy during the entire necessary period for this, but no more than 5 (five) years from the date of the User’s last interaction with the Portal.

DATA PROTECTION

6.1 The site administration, when processing Data, applies all necessary technical, organizational, and legal measures to protect Data from illegal and/or unauthorized access to such Data, including changes, deletion, provision, distribution, as well as other illegal actions.

6.2 The company constantly monitors the security measures taken.

ADDITIONAL CONDITIONS

7.1 The Company reserves the right to change the terms of this Policy at any time. In this case, the updated version will be posted on the main page of the site. If the User does not agree with the changes, he undertakes to immediately stop any interaction with the site

7.2 The site administration is not responsible for damage or losses suffered by the User or third parties as a result of misunderstanding or misunderstanding of the terms of this Policy.

7.3 If any provision of this Policy, including any offer, clause or part thereof, is recognized as contrary to the current legislation of Monaco, or invalid, this will not affect other provisions, they remain in full force and continue to operate in are in full force and effect, and any invalid provision, or provision that cannot be fulfilled, without further action by the Parties, is considered changed, corrected to the extent that it is necessary to ensure its validity and the possibility of implementation.

7.4 Terminology used in this Policy has the same meaning as in the Agreement unless otherwise specified.
